A Longford woman has had a careless driving charge struck out following a lengthy hearing at last week’s sitting of Longford District Court.
Pauline O’Brien, 12 Cluain, Coanagh, Kenagh, Co Longford, was driving home from Longford on the evening of November 23, 2020, when she collided with a lorry that was reversing into a farmyard on the long, straight stretch of road between Longford and Kenagh.
During last week’s hearing, the prosecution made the case that the lorry had all of the relevant lights on and that Ms O’Brien should have seen the vehicle as she had a 900m stretch of straight road ahead of her.
The defence, however, argued that the manouvre being carried out by the driver of the lorry was a dangerous one and should not have been done at night.
Judge Bernadette Owens ruled that the case was one for the civil court and struck out the charge.
