A north Longford man was left with a broken collarbone after being “kicked and punched” during an assault in the front garden of his home last year, a court was told last week.
Ciaran O’Reilly sustained the injury as a result of an attack at the hands of Alan Kelly, 8 Colmcille Terrace, Granard on July 7, 2022.
The court heard how Mr Kelly called to the home of his victim at 9 Trumra Road, Granard, Co Longford at around 6pm.
Inspector Declan McGlynn, on behalf of the State, said the episode was one Mr O’Reilly had not fully recovered from over eight months on.
“It is alleged that Alan Kelly arrived at the home of Ciaran O’ Reilly and called him out to the front garden of the home and tried to grab him out from behind the garden wall,” said Inspector McGlynn.
“Ciaran O’Reilly pulled back and Alan Kelly then entered the garden and ran for Ciaran O’Reilly, knocking him to the ground.
“Ciaran O’Reilly was punched and kicked and while on the ground and suffered a broken collar bone to his left shoulder as a result of the incident.”
Upon hearing details of evidence, Judge Bernadette Owens accepted jurisdiction after a medical report taken last August was handed into the court.
Judge Owens asked if Mr O’Reilly had been forced to undergo any surgical intervention or suffered from any long term sequela as a result of the incident.
Following a brief interlude and contact being made with Mr O’Reilly it was revealed by Inspector McGlynn that the victim’s shoulder was “functioning, but not at 100 per cent”.
The inspector added a file was sent to the Director of Public Prosecutions (DPP) with the results returning directions that the case be dealt with summarily or before a District Court judge.
In defence, solicitor Frank Gearty said his client would be pleading guilty to the matter when the case is formally adjudicated on.
Inspector McGlynn sought a two week adjournment to allow for the preparation of a victim impact statement.
Mr Kelly was remanded on continuing bail to a sitting of Longford District Court on April 18.
