Defendant to Judge Bernadette Owens: “It won't make any difference, I won't be able to pay it anyway.”
A defendant who racked up €1,260 in court fines, but claimed to be unable to pay them, was sentenced to five days in custody at Longford District Court.
Thomas McDonagh (41) of 43 Templemichael Terrace, Longford came before Judge Bernadette Owens on a bench warrant for five outstanding fines. Mr McDonagh was fined €250 for a drink driving offence in January of 2018, another €250 for a no insurance conviction on April 4, 2018.
A fine of €400 for drink driving on April 4, 2018 was also imposed, and two fines of €180 for engaging in threatening and abusive behaviour and failing to comply with the directions of a Garda on June 29, 2019.

The defendant said he was not in a position to pay a fine. Judge Bernadette Owens asked if he would like time to consult with a solicitor, however Mr McDonagh said: “It won't make any difference, I won't be able to pay it anyway.”
He told the court he was the father of five children and works five day a week. He said he had no money to pay the fines and claimed his work load made him unable to engage in community service.

In concluding matters Judge Owens said: “You've made this decision” and sentenced Mr McDonagh to five days in custody.
