Longford court hears ‘new information had come to light’ in assault case

A defendant originally refused to be served with a book of evidence by gardaí, but agreed to have it accepted on her behalf by her solicitor, allowing her to be sent forward for trial at the next sitting of Longford Circuit Court.

Ciara O’Neill, Kilmoyle, Killoe, Co Longford was sent forward for trial on a charge of assault causing harm at Newtownbond, Edgeworthstown on May 4 last.

The defendant originally refused to have the book served on her, but she later consented for her solicitor Diarmuid Quinn to accept the book of evidence on her behalf.

The defendant told the court that she had appeared in the court in June, and this had not been the order of the court at that time and she understood the case was to be dealt with in the district court.

Sgt Enda Daly told the court that new information had come to light and the directions from the Director of Public Prosecutions (DPP) was for trial by indictment in the circuit court.

Judge Bernadette Owens said the sequence of events had been explained. She said the original directions had been for summary disposal in the district court, but when the file was resubmitted, the DPP direction was for trial by indictment in the circuit court.

“I can’t interfere with that process,” Judge Owens said.

Mr Quinn then accepted the book on behalf of his client and the defendant was sent forward for trial to the next sitting of Longford Circuit Court.
