South Longford man who obstructed garda and told him to m to 'F**k off' is jailed by judge

The case was heard at Longford District Court

A man has been jailed for five months for a series of offences in county Longford and the Midlands.

Kevin Carberry (35) of Killinure, Lanesboro pleaded guilty at Longford District Court to two public order breaches at Townparks, Longford and of obstructing a garda at the same location on October 13 last.

Sergeant Enda Daly, for the State, said Gardai were called as the defendant was leaving a house and he left without incident, however, while outside Mr Carberry was intoxicated and he started insulting and threatening Garda Shiel and he continued to tell him to 'F**k off'.

"He was told to go home and leave the area but he failed to do so.

"He then made a swing for Garda Shiel who managed to restrain him and he was arrested for public order.”

Sgt Daly also said Gardaí were on patrol on Main Street, Longford when they noticed the defendant was highly intoxicated and acting in an aggressive manner and he was subsequently arrested and brought to Longford Garda Station.

Sgt Daly said gardaí received a report of a man causing a disturbance at 6.20pm at Pearse Street, Mullingar on January 27 last at a McDonald's restaurant.

"The man was throwing rubbish around the inside of the restaurant and he was not making any sense.

“Gardaí called to the scene and there were children and families present.

"The male was in an agitated state.

"Staff at McDonald's informed Gardaí at the scene what the man had been doing, he made admissions to smoking cannabis and he was under the influence of an intoxicant.

"He was rambling and incoherent and he was subsequently arrested and conveyed to Mullingar Garda Station."

The court heard previously how the defendant had been in Garda custody on January 13 last when he caused criminal damage to a cell at Longford Garda Station with the damage estimated at €150.

The defendant had five previous convictions.

Solicitor Diarmuid Quinn said his client has lived up to 35 'without much incident'.

"Dr O'Keefe put a lot of the offending behaviour down to the use of alcohol and drugs,” he added.

Mr Quinn, who said the report also referred to a 'lot of childhood trauma', said his client had pleaded guilty at the earliest opportunity and he has been in custody since February 17.

Judge Bernadette Owens said the 'substantial probation report 'shows what Mr Carberry had to contend with and she imposed a five month prison sentence, which was backdated to the date the defendant was taken into custody.
